Got the short end of the stick with GEICO?
I've been with GEICO for 12 years with no accidents that were my fault. I was in a car accident recently. I was on the highway, stopped in traffic on a Friday afternoon. A car slammed into the back of me, pushing my vehicle into the vehicle in front of me. The vehicle that struck me, struck me 3 times. My foot on the brake, her foot on the accelerator. The woman in front of me had 2 other pengers. She gets out of her car to come check on me, but the woman who struck my vehicle got out of her car with her penger and ran up to the woman whose car I struck as a result of being hit by the vehicle behind me. When the woman in front of me tried to come back to my vehicle, the woman behind me and her male penger would not let her come to my car. The woman who hit me came running to my car, apologizing and crying. At this time, I realized that no one called the police. I'm stuck in my car, in pain and really confused at the fact that no one called the police. I reached for one of my phones that was thrown out of my bag and called 911. The paramedics and fire dept arrived within minutes, but the state trooper did not arrive while I was at the scene of the accident. The paramedics and F.D. had to remove me from my car from the penger side and transport me to the ER. 2 hrs later while I'm in the ER, the state trooper comes in and gives me 3 tickets. He had the tickets pre-written so all he needed from me was my driver's license. He wouldn't listen to a word I said with regard to the accident. I called my attorney immediately. The officer stated that the 2 drivers, the woman who struck me and the woman I struck are stating that I struck the woman twice. Well, this would make sense because my vehicle was struck 3 times from behind by the same vehicle...over and over. Keep in mind, the woman who I struck was kept from coming to my vehicle by the woman who struck my car and her penger. The woman who hit me told the officer that she was going 15 mph when she hit me. The woman in front of me told the officer that she felt an impact and when she looked in her rearview mirror, that's when she saw me get hit. WTF. I was stopped!!! In traffic!!! On a Friday @ 5pm!!! I was NOT moving!!! I gave GEICO so much info, but they found me 50% at fault because of what the police report stated and what the driver in front of me stated. Oh, to add insult to injury, GEICO was unable to get hold of the owner of the vehicle in front of me to take pictures. They have no pictures of this woman's car and there was also no damage to the front of my vehicle. I say 'was' because my vehicle was deemed a total loss. I have no car, I'm constantly in pain and GEICO is stating that I had no medical coverage on my vehicle for me, but that I had medical coverage for other drivers who I may have injured. Sounds a little suspect to me but, how do I fight that? I am 0% at fault, but I was found to be 50% at fault because of all of the lies being told and the state trooper who summoned me to court. If I haven't gone to court and was found guilty, how could GEICO go by what the police report stated and find me guilty? No one's car is deemed a total loss when they were hit at 15 mph...This chick was going at least 40. GEICO paid me for what my car was worth. Oh, did I add that the person who hit me is also covered by GEICO? Help. Please.
